Delays caused by failure to provide requested materials or approvals may affect project timelines and are not the responsibility of Divine Eye Marketing Solutions.
Payment Terms
Payment terms, rates, and billing schedules will be specified in your individual service agreement. Invoices are due upon receipt unless otherwise agreed in writing. We reserve the right to pause or terminate services for accounts with outstanding balances. All fees are non-refundable unless explicitly stated otherwise in your service agreement.
Intellectual Property
Upon receipt of full payment, clients own the final deliverables created specifically for them under a service agreement. Divine Eye Marketing Solutions retains ownership of all proprietary tools, methodologies, templates, and pre-existing intellectual property used in delivering services. We reserve the right to reference your business name and results in our portfolio, case studies, and marketing materials unless you request otherwise in writing.
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, financial information, and any materials marked as confidential. This obligation survives the termination of any service agreement.
Limitation of Liability
Divine Eye Marketing Solutions does not guarantee specific results from our marketing services, as outcomes depend on many factors outside our control including market conditions, platform algorithm changes, and competitive landscape. To the fullest extent permitted by law, Divine Eye Marketing Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability for any claim shall not exceed the fees paid by you in the three months preceding the claim.
Termination
Either party may terminate a service agreement with written notice as specified in that agreement. Upon termination, you are responsible for payment of all services rendered up to the termination date. We reserve the right to terminate services immediately for violation of these terms or non-payment.
